У англійських галер зріс сукупний борг і збільшився ‘lock-up time’

Загальний борг топ-50 англійських фірм складав £5.4 ярди. У 2023 він зріс на £177М у порівнянні із 2022. Це підрахунки англійської бухгалтерської фірми Lubbock Fine на основі нещодавно поданої юристами фінансової звітності.

Бухгалтери пояснюють це збільшенням “lock-up time” — це строк виконання проєкту (work in progress) плюс строк, який потрібен клієнту для оплати роботи. Так от, цей lock-up time у 2022 році складав у середньому 122 дні, а у 2023 році зріс до 124 днів.

Марк Тернер (Mark Turner), партнер Lubbock Fine, каже, що через економічний спад клієнти довше оплачують рахунки, а фірма має регулярно виплачувати партнерську винагороду та інвестувати, тож аби уникнути касових розривів, юридичні фірми збільшують свої кредитні лінії.

З приводу збільшення lock-up days під згаданою публікацією The Law Society Gazette розгорнулася невелика дискусія. Я розумію, що аналізувати анонімні коментарі це трешово, але там є дійсно хороші:

Ось ексгребець публічної юридичної фірми DWF каже, що на партнерів просто звалюється забагато неюридичної роботи, от і страждають строки виконання проєкту. А ще фінансові департаменти якісь неефективні:

Having worked at DWF and other similar firms, the problem is with the lackadaisical Finance teams, and the bloated non-fee earning middle management letting them get away with it.

The finance teams require so much chasing and input from fee earners they are often more of a hindrance.

The non-fee earning middle management spend their days floating from one pointless meeting to the next stroking their egos trying to get fee earners to do as many tasks outside of fee earning as possible whilst expecting them to maintain 7 hours+ chargeable hours per a day.

Here is a crazy business thought: Let the fee earners focus on earning fees, and give them as little non-chargeable tasks as possible. – Why take time away from those actually making the money! Get the departments like finance in shape to do what they are meant to be doing.

Анонім каже, що юридичні фірми часто додають у рахунки купу нерелевантного часу, чим змушують клієнта прискіпливо перевіряти брейк-даун. Особливо його бісить те, що юристи додають у рахунок час, який джуни обговорювали проєкт між собою. А ще каже, що фінансові департаменти часто лажають і невчасно виставляють рахунки:

I acted for one client whose probate case was transferred to a large London firm and he asked me to keep a watching brief. I was horrified at how much time was recorded, and attempted to be charged, for junior staff discussing the case with each other – thousands of pounds! Clients need to check their solicitors’ bills and partners need to be honest about what they seek to charge for.

Another firm charged insurers for putting right their (the solicitors’) mistake – I know because they sent me the VAT invoice to be paid which I refused to pay and reported them to the insurers’ chief executive (who I happened to know). Insurers subsequently ceased instructing that firm.

When I discovered my former firm’s finance department was inefficient at collecting debts I took to producing reminders and made a diary note to send them, one a month after sending the bill, a second after two months and a third formal one after three months usually saying if they were not a client I would be sending a letter before action at that point. Most paid on delivery of the bill or on the first reminder (and some said they were waiting for the reminder before paying). I had virtually zero bad debts.

Give try, I can say from experience it works and clients will respect you for running an efficient business.

Law firms have this habit of making lawyers be technical experts, management, marketing and finance whist at the same time placing KPIs on chargeable time per day. If you say to a lawyer you must record 7 chargeable hours a day, that is what they will do to the exclusion of everything else. Perhaps the metric should be 6.5 chargeable hours a day and 0.5 recorded hours on finance (cost estimates, billing and chasing unpaid invoices). Either that or get the finance teams to do the finance not lawyers.
