War Crimes Committee Conference - Session 4: The challenges to undertaking domestic and hybrid trials for atrocity crimes

Many feel that accountability for atrocity crimes is best undertaken in the communities where the crimes occurred and that the victims call home.  However, this assumption has been questioned by some based on past experiences.  This moderated event will discuss the challenges of establishing domestic and hybrid courts, including political, legal, societal and resource hurdles.  Building upon lessons learnt (such as from the Special Court for Sierra Leone, Extraordinary Chambers in the Courts of Cambodia, Iraqi High Tribunal and the Special Tribunal for Lebanon), the panel will explore current situations needing accountability measures, for example South Sudan.  While the International Criminal Court understandably garners much attention, it intervenes only when the relevant State is unwilling or unable genuinely to carry out an investigation or prosecution.  The panel will consider options to end impunity for atrocity crimes, starting with the affected State.
