War Crimes Committee Conference – Session 1: The situation in Ukraine

Since the beginning of Russia’s invasion of Ukraine on 24 February 2022, there have been multiple reports of violations of international humanitarian law and other atrocity crimes. An unprecedented 41 state parties to the Rome Statute have referred the situation to the International Criminal Court and many experts have called for the establishment of a new tribunal with jurisdiction over the crime of aggression to deliver justice in respect of the events in Ukraine. At the same time, domestic trials pursuant to universal jurisdiction have increased in prevalence in recent years, presenting a further route to justice. This panel will address the institutional avenues that may potentially be utilised to investigate, prosecute and adjudicate the crimes reported to have occurred in Ukraine in connection with the invasion. In this context, it will examine ‘the principle of complementarity’, immunities and the jurisdictional parameters that apply to each option for justice.
